Revisions to Digital Signature and Seal Regulations in Ukraine

Recent legislative updates in Ukraine have significantly altered the landscape for electronic signatures and seals, streamlining digital document management and enhancing legal clarity.

Electronic Signature Mandate

The primary challenge addressed by recent Ukrainian legislative updates was the restrictive and often cumbersome requirement for qualified electronic signatures (QES) to be stored on secure hardware tokens for many electronic public services. This mandate, while ensuring high security, created significant friction in daily operations and hindered the broader adoption of digital document workflows, particularly for advanced electronic signatures (AES) which were previously confined to an 'experimental project' during martial law.

Impact on Digital Workflows

The previous token-based QES requirement impacted the efficiency and accessibility of electronic document management across various sectors. Organizations faced increased logistical hurdles and costs associated with acquiring and managing these tokens, slowing down signing processes and limiting the ease with which electronic services could be utilized. To resolve these issues, the Cabinet of Ministers of Ukraine, via Resolution No. 1298 of December 12, 2023, approved new requirements for AES and seal formats. This crucial decision largely eliminates the mandatory QES token requirement for AES in most contexts, unless specifically mandated by law, thereby allowing for continuous and more flexible use of AES. Concurrently, the National Bank of Ukraine (NBU) issued Resolution No. 172 of December 20, 2023, establishing a unified regulation for electronic signatures and seals within the banking system, non-banking financial services, and payment services. This NBU regulation clarifies the legal validity and application of all types of electronic signatures, irrespective of their creation technology, providing much-needed clarity for financial institutions and their clients.

The combined effect of these legislative changes is a significant streamlining of electronic document signing processes, making them more accessible and convenient for a wider array of users and businesses. These updates also serve to harmonize Ukrainian legislation on electronic trust services with prevailing European standards, fostering greater integration and facilitating international cooperation.
